Welcome to Justine's Virtue. These Terms & Conditions govern your use of our website and the purchase of our products. By accessing this website or placing an order, you agree to be bound by these Terms & Conditions.
1. About Us
Justine's Virtue is a Black-owned, Canada-based contemporary designer jewellery brand creating bold, unisex jewellery inspired by individuality, self-expression, queer culture, and kink aesthetics.
2. Acceptance of Terms
By using this website, you confirm that you have read, understood, and accepted these Terms & Conditions.
If you do not agree with these Terms, please do not use this website.
3. Age Requirement
Our collections contain mature artistic themes and are intended for adults.
By placing an order, you confirm that you are at least 18 years of age, or the age of majority in your jurisdiction, whichever is higher.
4. Product Information
Every effort is made to ensure product descriptions, dimensions, photographs, pricing, and specifications are accurate.
Because many of our pieces are individually finished or handmade, slight variations in colour, finish, polishing, dimensions, weight, and texture may occur.
These variations are considered part of the character of the jewellery and are not manufacturing defects.
Screen settings may also cause colours to appear differently.
5. Pricing
All prices are displayed in Canadian Dollars (CAD) unless otherwise stated.
Prices may change without notice.
We reserve the right to correct pricing errors and cancel orders affected by incorrect pricing. Where payment has already been received, a full refund will be issued.
6. Payment
Payment must be received in full before production or shipment.
We reserve the right to refuse or cancel any order where fraud, unauthorised payment, unlawful activity, or misuse is reasonably suspected.
7. Made-to-Order Jewellery
Many Justine's Virtue pieces are made specifically for each customer.
Production begins after payment has been received.
Production times are estimates only and may vary depending on demand, material availability, or manufacturing schedules.
8. Precious Metal Orders
Sterling silver and 14k gold jewellery are individually made to order.
Because these pieces are created specifically for each customer, they are generally considered final sale unless required otherwise by applicable law or where a manufacturing defect exists.
9. Custom Orders
Selected designs, including the TOUGH LOVE pendant, may be customised.
Available options may include:
Alternative sizes
Alternative metals
Alternative finishes
Bespoke modifications where technically possible
Once a custom order has entered production, cancellations, refunds, or design changes may not be possible except where required by law.
Quotes remain valid for 30 days unless otherwise stated.
10. Shipping
Orders are shipped using trusted courier services including FedEx and DHL.
All shipments include tracking.
Customers will receive shipping confirmation and tracking information once their order has been dispatched.
Estimated delivery times are provided as guides only and cannot be guaranteed.
We are not responsible for courier delays caused by customs inspections, severe weather, industrial action, transportation disruptions, or other events beyond our reasonable control.
11. Customs & Import Charges
International customers are responsible for all customs duties, VAT, GST, brokerage fees, import taxes, or similar charges imposed by their destination country.
These charges are not included in our prices or shipping fees.
12. Lost or Damaged Shipments
If your parcel is lost or arrives damaged, please contact us within 7 days of delivery or the expected delivery date.
We will work with the courier to investigate the shipment.
Any replacement or reimbursement will be subject to the courier's investigation and the applicable shipping insurance.
13. Incorrect Shipping Information
Customers are responsible for providing accurate shipping information.
Additional shipping charges resulting from incorrect addresses or refused deliveries remain the responsibility of the customer.
14. Returns
Please refer to our separate Returns Policy.
Made-to-order, customised, personalised, and bespoke jewellery cannot normally be returned unless required by law or where a manufacturing defect exists.
15. Jewellery Care
Customers should follow our Jewellery Care Guide.
Normal wear, accidental damage, misuse, improper storage, exposure to chemicals, unauthorised repairs, or modifications are not considered manufacturing defects.
16. Brass & Black Rhodium
Brass naturally develops a patina over time.
Black rhodium plating will gradually wear with regular use, revealing the underlying metal.
These changes are natural characteristics of the material and are not considered defects.
17. Product Disclaimer
Justine's Virtue creates fashion jewellery and wearable art.
Our products are not intended or certified for use as:
BDSM equipment
Restraints
Safety equipment
Protective equipment
Impact implements
Weapons
Self-defence devices
Medical devices
Body piercing jewellery
Customers use our products entirely at their own risk.
18. Product Safety
Please inspect jewellery regularly.
Discontinue use if any component becomes loose, damaged, or broken.
Small components may present a choking hazard.
Keep jewellery away from young children and pets.
19. Allergies
Although we use high-quality materials, including 316L stainless steel, sterling silver, brass, and gold, individual skin sensitivities vary.
Customers are responsible for reviewing material information before purchase.
Justine's Virtue cannot guarantee compatibility with every individual and is not liable for allergic reactions.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Justine's Virtue shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of this website or our products.
Our maximum liability shall not exceed the purchase price paid for the relevant product.
Nothing in these Terms limits any rights that cannot legally be excluded under applicable law.
21. Force Majeure
We shall not be liable for delays or failures resulting from events beyond our reasonable control, including natural disasters, severe weather, pandemics, labour disputes, government action, customs delays, transportation disruptions, cyber incidents, supplier shortages, or courier interruptions.
22. Intellectual Property
All jewellery designs, product concepts, CAD files, wax models, moulds, artwork, logos, branding, product names, website design, photography, graphics, written content, and marketing materials are the intellectual property of Justine's Virtue unless otherwise stated.
No material may be copied, reproduced, manufactured, scanned, cast, reverse engineered, distributed, or commercially exploited without prior written permission.
The purchase of a product does not transfer any intellectual property rights.
23. Trademarks
The Justine's Virtue name, logo, branding, and associated marks may not be used without written permission.
24. Product Photography
Editorial features and product reviews are welcome, provided appropriate credit is given to Justine's Virtue.
Commercial use of our images or marketing materials requires prior written consent.
25. Right to Refuse Service
We reserve the right to refuse service, cancel orders, or decline transactions where we reasonably believe fraudulent activity, abusive behaviour, unlawful conduct, or misuse of our products may occur.
26. Privacy
Please refer to our Privacy Policy regarding the collection, storage, and processing of personal information.
27. Governing Law
These Terms & Conditions are governed by the laws of the Province of Québec and the applicable federal laws of Canada.
Any dispute arising from these Terms shall be subject to the jurisdiction of the courts of Québec, except where applicable consumer protection laws provide otherwise.
28. Changes to These Terms
We reserve the right to amend these Terms & Conditions at any time.
The version published on our website at the time your order is placed will apply to your purchase.
